WIPO Expert Determination

WIPO Expert Determination has a number of characteristics that suit the needs of parties requiring an IP valuation. It allows parties to choose an expert in IP valuation with the required expertise. WIPO Expert Determination also provides a neutral forum where disputes – sometimes involving parties from multiple jurisdictions – can be resolved in a time- and cost-effective manner through a single procedure. IP valuation also plays an important role in the calculation of damages and the determination of royalties in pending court or arbitration proceedings.

Procedural Assistance

The WIPO Center makes available recommended contract clauses and submission agreements that parties can use to opt for WIPO Expert Determination.

The WIPO Center provides procedural guidance to interested parties free of charge. This includes advice on the selection and adaptation of WIPO clauses in related contracts or submission agreements. The WIPO Center also facilitates the submission to WIPO Expert Determination even in the absence of an agreement.

Submission to WIPO Expert Determination

The WIPO Expert Determination Rules offer a flexible procedural framework for IP valuation. Furthermore, the WIPO Center makes available to interested parties, at no cost, online case administration options, including an online docket and videoconferencing tools for meetings and hearings. The WIPO Center offers WIPO Expert Determination for IP Valuation to assist parties conducting IP valuation in a cost- and time-efficient manner under the WIPO Rules.

WIPO Expert Determination can be initiated by one party only, or jointly by both parties.

WIPO open-ended List of Experts Specialized in IP Valuation

Effective proceedings often depend on the quality of the expert. The WIPO Center maintains an international open-ended List of Experts from around the world for parties to WIPO Expert Determination proceedings, including experts in IP and technology valuation. Parties are also free to select experts from outside the WIPO List of Experts.

Joint WIPO-IPOS Open-Ended List of Experts Specialised in IP Valuation

In collaboration with the Intellectual Property Office of Singapore (IPOS), the WIPO Center has identified a list of professional Experts in IP valuation in Singapore. Such experts may conduct an IP assessment and valuation (expert determination) or act as witnesses in court or arbitration proceedings.
