Workshop on IP Dispute Resolution - Litigation, Mediation and Arbitration in the United States of America, China and Germany

Overview

In a globalized world, international business transactions are increasing in number, size and complexity. Such complex transactions require during their lifetime, careful management to take account of changes and disputes which may arise. If the parties to the transactions are domiciled in different jurisdictions, or if intellectual property (IP) is protected in several countries, resolving cross-border disputes through litigation in national courts may involve additional risks. For example, there may be concerns as to the choice of the appropriate forum, conflicting results in parallel court proceedings in different countries, the neutrality of the court, unfamiliar procedural practices and a lack of enforceability of court judgments outside the jurisdiction where they were obtained. Dispute resolution strategies may include out-of-court dispute resolution mechanisms, for example mediation, arbitration or expert determination administered by the WIPO Arbitration and Mediation Center.

This workshop will focus on the three main regions for the exploitation and enforcement of IP rights: United States of America, China and Germany. Renowned industry speakers from high-tech, automotive and pharmaceutical companies will present their extensive experience at the frontline of IP dispute resolution, in particular related to costs, duration and enforceability.

The workshop is organized by the WIPO Arbitration and Mediation Center and supported by the law firm Taylor Wessing, and the Association of Intellectual Property Experts (VPP).
