Personal Name Registrations
- Only for personal names (described as the legal name or the name by which the person is
commonly known)
- of an individual or
- of a fictional character provided applicant has a trademark in that name
- additional distinguishing elements (e.g. numbers) permitted
Defensive Registrations
During Phase I (ended in 2002)
- Only for trademarks (i) the textual elements of which are identical to the reserved string,
that (ii) have national effect and (iii) were registered prior to April 16, 2001
During Phase II
- No registration restrictions

Pre-Registration Trademark Protection Mechanisms:

- Trademark owners have the exclusive opportunity to apply for a Defensive Registration during
phase I in order to reserve a particular alphanumeric string and to block personal name
registrations that include the registered alphanumeric string on either the second or the third or
on both levels

Disputes involving Personal Name Registrations
- Subject to Eligibility Requirements Dispute Resolution Policy (ERDRP)
- For disputes concerning compliance with registration restrictions
- Remedy: Transfer if complainant meets registration restrictions, otherwise opportunity to
register a defensive registration

Disputes involving Phase I Defensive Registrations
- Subject to ERDRP only
- For disputes concerning compliance with registration restrictions regarding phase I defensive

registrations held by the respondent for compliance with registration restrictions; (iii)
registration of personal name of complainant if complainant meets eligibility requirements; (iv)
fee-refund for complainant
